Refunds & Returns Policy — TA Art (Australia)

This Refunds & Returns Policy applies to all purchases made through TA Art, in accordance with the Australian Consumer Law (ACL).

1. Overview

At TA Art, we want you to feel confident in your purchase. Your rights under the ACL are protected, including guarantees that goods will be of acceptable quality, match their description, and be fit for purpose.

These consumer guarantees cannot be excluded.
You may be entitled to a repair, replacement, or refund, depending on the circumstances.

This policy outlines how TA Art handles returns where statutory guarantees do not require a remedy (for example, change-of-mind returns).


2. Change-of-Mind Returns

Because our products are artworks and creative goods, many of which are original pieces, we do not offer refunds or exchanges for change-of-mind purchases unless required by law.

If we choose to accept a discretionary return, the item must:

  • be unused and in the same condition as received,
  • be returned in original packaging, and
  • include proof of purchase.

Any approved discretionary returns must be initiated within 30 days of delivery.


3. Items Not Eligible for Return

Unless required by law, the following items cannot be returned:

  • Original artworks damaged after delivery
  • Commissioned or custom works
  • Digital downloads (e.g., digital prints, files)
  • Gift cards and vouchers
  • Personal-care items (if ever offered)
  • Any item that is altered, used, or no longer in original condition

4. Statutory Rights for Faulty or Defective Goods

Under the ACL, you are entitled to a remedy if an item:

  • is faulty,
  • is not of acceptable quality,
  • does not match its description, or
  • is not fit for purpose.

If the issue is major, you are entitled to a replacement or refund.
If the issue is minor, TA Art may choose to repair or replace the item.

To request a remedy, please contact us at {email address} with:

  • your name,
  • proof of purchase, and
  • clear photos or details of the fault.

Do not return the product until we confirm the next steps.


5. Refund Process

Once your returned item arrives and is assessed:

  • We will notify you by email that it has been received.
  • We will confirm whether your refund, repair, or replacement is approved under the ACL.
  • Approved refunds will be processed to your original payment method.
    Processing times may vary based on your bank or payment provider.

If Your Refund Has Not Arrived

  2. Contact your bank or credit card provider — processing delays are common.

6. Sale Items

If an item is discounted because of an identified defect, it cannot be returned for that defect.
Otherwise, sale items enjoy the same rights under Australian Consumer Law as full-priced goods.


7. Exchanges

We can only provide exchanges for the same item where:

  • the item is defective, and
  • an identical replacement is available.

If replacement is not possible, your statutory rights apply (refund or alternative remedy).

8. Gifts

If the item was marked as a gift and shipped directly to you:

  • You will receive a gift credit equal to the value of the return, once processed.

If the item was not flagged as a gift:

  • The refund will be issued to the original purchaser.

9. Returning Items to Us

Returns (where authorised) should be sent TA Art Address:

Unless required by law, the customer is responsible for return postage costs.
Shipping costs are non-refundable, except where the return is due to a consumer guarantee failure.

For high-value artwork, we strongly recommend:

  • using a trackable delivery service, and
  • purchasing shipping insurance.

TA Art is not responsible for return items lost in transit.
